How to win a Chargeback!

A chargeback is a mechanism designed by the credit card companies to protect their card holders against unscrupulous merchants! It allows a merchant to pay with a credit with confidence that if the product is faulty, does not arrive, does not meet the expectations sold by the merchant, the customer can reach out to their credit card company and initiate a "dispute" for the money spent. 


Common Customer Dispute Categories: 

No knowledge Dispute - The customer tells their credit card company they do not recognize the transaction and initiate a dispute to get their money back. 

    How to avoid this type of dispute: 

  • Make sure the name of your business is spelled correctly with your merchant processing company and shows correctly on any receipts, invoices & credit card statements. 
  • Make sure that the name your customer knows you as is showing on customer credit card charges. 
  • Do Not set up your credit card company with your legal entity name unless it is the same name your customer see on your website/storefront and business card. 
  • Example: Store name is Frank's Deli but your processor set your account up under the legal entity name of Smith's Enterprises LLC. This will immediately raise a flag to customers when they do not know that your store's legal entity name on the transaction is actually Frank's Deli! 


Product Returns Dispute - The customer tells their credit card company that they wanted to return the product and could not. 

    How to avoid this type of dispute:

  • Make sure that your company's RETURN POLICY is prominently posted in the store (near the cash registers), online before checkout, and on ALL RECEIPTS! 
  • Make sure your company has specific Warrantees/Guarantees also posted in stores and online. 
  • If the customer is entitled to a REFUND, make sure they are PAID within 7 days of receipt of the product. 
Product Not Received Dispute- This customer has already paid for an item to be delivered and it does not arrive. 

    How to avoid this type of dispute:
  • Make sure that the customer receipt gives an expected delivery date of their purchase.
  • Send a receipt to customer along with the Shipping Company's Tracking information
  • Stay in touch with the customer via email/text to give any shipping delay from the manufacturer or shipping company. 
  • Make sure your shipping company delivers to the correct customer location and takes a photo of the delivery.

Visa Agrees to Landmark Settlement with U.S. Merchants Reducing Rates and Guaranteeing No Increases for at Least Five Years

SAN FRANCISCO--(BUSINESS WIRE)--Mar. 26, 2024-- After nearly 20 years of litigation, Visa (NYSE: V) today announced it has agreed to a landmark settlement with U.S. merchants, more than 90 percent of which are small businesses, lowering credit interchange rates and capping those rates into 2030. The settlement also provides updates to several key network rules giving merchants more choice in how they accept digital payments.

The agreement’s multi-year benefits for businesses include:

  • Lower interchange rates. The settlement will reduce credit interchange rates for U.S. merchants, comprised largely of small businesses.
  • Interchange rates will not go up. The agreement will cap the reduced credit interchange rates for five years, providing an unprecedented level of cost certainty long sought by merchants.
  • New ways to manage costs. The settlement gives merchants greater flexibility at the point-of-sale, including the opportunity to steer to preferred payment methods and more optionality around surcharging. It also provides funding for new programs to educate small businesses about payment acceptance options and how to best manage costs.

“By negotiating directly with merchants, we have reached a settlement with meaningful concessions that address true pain points small businesses have identified,” said Kim Lawrence, President, North AmericaVisa. “Importantly, we are making these concessions while also maintaining the safety, security, innovation, protections, rewards and access to credit that are so important to millions of Americans and to our economy.”

Today’s settlement agreement with merchants resolves claims against Visa, Mastercard and other defendants brought by the injunctive relief class in the lawsuit entitled In re Payment Card Interchange Fee and Merchant Discount Antitrust Litigation. It is subject to approval by the court.

Deduct merchant fess or avoid paying them!

 

It's Tax Time...AGAIN! 

Merchant Paid Processing Fees: 

  • Merchant processing fees are tax-deductible. They are part of running your business.
  • Your processor is required to provide a 1099-K no later than January 31st.
  • This deduction doesn’t affect your company’s total tax liability; the tax deduction is subtracted from your gross earnings which will lower the total taxable income amount.
  • Only Businesses are eligible to deduct credit or debit card processing fees associated with paying taxes, not individuals. 
  • Remember this year Cash App/Venmo/Zelle will also send 1099-K forms! 

Customer Paid Processing Fees: 

  • Customer Surcharging and Cash Discount is allowed in the state of Florida. 
  • Instead of the merchant paying the processing fees from their sale, the merchant account "legally" adds the up to 3% surcharge or the up to 4% Cash Discount fees. No need for guessing.

What's worse than software integration?

Trying to intergrate your industry software with a reasonally priced merchant processing company can be very challenging! Why... you ask? It's because software companies have partner agreements with a exclusive processing companies to integrate. These partnerships are legal and most software companies recieve a percentage of each sale along with their monthly fees! This is why most software integrated processing is higher then those without the software. But there are a few steps you could
do to take advantage of your software and get much lower processing rates! 

So here are a few tips BEFORE you sign with a specific software company:

  • Can your software processor do Surcharge of Cash Discount? 
  • Ask how do I process my credit cards using your software? 
  • Do you have a exclusive credit card processor that you are associated with that would be the ONLY processor I can use? 
    • If they have several options; ask the rates and functionality of each.
  • Does your software for invoicing allow me to put my own Payment Link in the invoice so my customers can click on that to pay me?
  • If the software uses Authorize.Net or USAePay, you would be able to shop around for the best pricing while having complete integration with your software.  (Best of Both Worlds!)
  • Retail business want to know if the software integrates with a credit card terminal/swiper to capture RETAIL RATES CREDIT CARDS & PIN DEBIT CARDS! Retail credit card rates are about 30 bases points lower while Pin Debit rates average around 1%. This is a huge savings to be missing due to the lack of functionality on a software provider. 
So what's the solution? 
  • Many of our merchants are saving 1-2% by have a retail terminal in their location that captures the data and uploads it to the payment software gateway. 
  • Some of our merchant use our QuickBooks Plug n'Play to bring in all the sales into their accounting software and not pay the high prices of processing with QuickBook. 
  • Both of the options above may require a 1-2 step reconciliation process from you or you office team but saving anywhere from 1-4%, if you are set up for Pin Debit/Surcharge/Cash Discount Pricing Methods. 
One final example: We had a merchant ask us about Surcharge/Cash Discount, she was already told that her current Industry Software Company was unable to accomodate that request. She call Merchant Processing Solutions to discuss possible options. She choose:
  • The change processors to us and add Cash Discount to her quotes when accepting credit card payments.

Visa / MasterCard Interchange Fee Settlement Recovery.

The lawsuit is about claims that merchants paid excessive fees to accept Visa and Mastercard cards because Visa and Mastercard, individually, and together with their respective member banks, violated the antitrust laws.

The settlement creates the following Rule 23(b)(3) Settlement Class: All persons, businesses, and other entities that have accepted any Visa-Branded Cards and/or Mastercard-Branded Cards in the United States at any time from January 1, 2004 to January 25, 2019, except that the Rule 23(b)(3) Settlement Class shall not include (a) the Dismissed Plaintiffs, (b) the United States government, (c) the named Defendants in this Action or their directors, officers, or members of their families, or (d) financial institutions that have issued Visa-Branded Cards or Mastercard-Branded Cards or acquired Visa-Branded Card transactions or Mastercard- Branded Card transactions at any time from January 1, 2004 to January 25, 2019. The Dismissed Plaintiffs are plaintiffs that previously settled and dismissed their own lawsuit against a Defendant, and entities related to those plaintiffs. WHEN IS "FREE" NOT FREE!

We LOVE FREE STUFF! But savvy purchasers know that this is ONLY a HOOK! It is designed to get you interested, make you sign up for something and then hit you with their real terms and conditions plus additionally needed products and services! 

Examples: 

  • Download a FREE Video Game through one of the App Stores - HOOK - To move forward and get points you must either listen to endless commercials or buy the points to continue playing! 















  • Online, you find a product that says FREE just pay for the Shipping & Handling - HOOK! Once you pay the S&H with your credit card, the small, undisclosed print that is hidden somewhere, says they can now charge you monthly for the same product until you CANCEL! But you never signed up!!! It was suppose to be FREE! 
As you can see there are plenty of FREE OFFERS but they ALL have stipulations that you need to know BEFORE you Sign-Up! 

The same with FREE Merchant Services Equipment! Free is NOT FREE when the following conditions are present: 
  1. Long-Term Contract (3-4 years) with a large Cancellation Fee
  2. No Warranty on the equipment after 1 year. If the device fails after year 1, you are totally responsible for the repair.

VENMO: Information that can save your business!



Venmo is a peer-to-peer (p2p) payment app, making it easy to send money to and from friends and family. It's widely used, you can send money by whichever payment method you want, and recipients get funds instantly. However, it was never really designed to be a payment method for businesses! 

Negative Points to Using Venmo Apps:

If you receive money, you MUST move it quickly to your bank account as Venmo is not FDIC Insured so if your money disappears from your Venmo account for whatever reason, unlike your bank, you are NOT protected! ! 

There are two options to transfer your money to your bank account: 

  • Venmo to your bank account fast: Instant transfers have a 1.75% fee, with a $0.25 minimum and a $25 maximum. 

  • Venmo to your bank account that takes one to three business days to settle is FREE! 

Although designed for personal to personal payments some folks have started using Venmo to get paid for business products and services. There are multiple reasons why you should NOT use it for business.

  1. Your customer needs to also get set up as a Venmo user PRIOR to any transaction.
  2. Your money is NOT secure! Venmo offers NO chargeback protection or fraud protection! 
  3. The buyer has NO protection if they send the money to fraudsters nor can they do a chargeback should they NOT get their product or service.
  4. Also all the Negative Points from above on the P2P Venmo account

Many people I have spoken to, tell me they use Venmo like cash and feel they do not have to report their earnings to the IRS. In July of the year, the IRS changed the law and now if you collect $600 or more for the sales of goods and services through a payment services company you MUST provide your Tax Info and you will be sent a 1099 for all sales $600 and higher. If you do not submit your tax info for yourself or your business, the payment services company (i.e. Venmo) is required to withhold 24% of those payments and send it to the IRS for backup withholding. This is required by the IRS and helps to ensure that any applicable taxes due on these payments are paid.

    A HUGE CHARGEBACK WIN FOR OUR MERCHANT!

     

    How a transaction dispute and chargeback is processed! 

    • A customer, for a number of reasons, doesn’t recognize a charge on their credit card statement or does not agree with something on that charge, contacts their CREDIT CARD issuing bank to dispute the charge.
    • The CREDIT CARD issuing bank reviews the customer’s dispute. They may deny the claim OR accept it.
    • If they siding with the customer, the issuing bank takes the cost of the CNP transaction plus any additional fees (Chargeback Fees - Approximately $30.00) out of the business’s merchant account. The issuing bank may refund the customer’s money, satisfying the customer.
    • The CREDIT CARD issuing bank records the chargeback information and relays it to the business’s Merchant Processing bank.
    • The business’s Merchant Processing bank reviews the data and either resolves the issue with data on file (like duplicate charge) or notifies the business.
    • If the Merchant Processing bank forwards the chargeback to the business, the business can accept the chargeback (lose the money) or dispute it back. The merchant will have to provide evidence that the customer made a legitimate purchase, knew the price, agreed to the price and received their purchase from the business. Providing evidence can be difficult if the business doesn’t know what is needed to RESERVE the Chargeback! 
    • With the merchant evidence in hand, the Merchant Processing acquiring bank represents the business’s chargeback dispute to the customer’s CREDIT CARD issuing bank. If the issuing bank sides with the business, it returns the transaction amount to the merchant account. If the issuing bank sides with the customer, the chargeback stands, and the business can pursue arbitration. In some cases, the issuing bank sides with the business but files a second chargeback if new information further supports the customer’s dispute.
